ITEM: 1 QUESTION TIME

1.1 Mr Philip McGinnity, 2 Thirlmere Road, Mt Lawley 6050.

With respect to Item 10.2/PL29.

Q.1 Why is it being considered that a four storey block of 17 units is being applied for when the residential zoning states that a building can only be a maximum of three stories?

Q2. How is it that these four storey units are allowed to break the set height restrictions of 9 metres by being 11 metres high?

Q3. Does the Council agree with the Office of Local Government's booklet "Guide to Good Residential Design" when it states that garages and carport should not:-

3.1 Diminish the attractions of the street.
3.2 Dominate the views of the house from the street.

If so how can this development be allowed?

Q4. Is the Council aware that the rear setback should be 9.5m but is only one metre? Does the Council understand that this will rob the resident diagonally opposite of his views across to Bardon Park and the foothills?

Q5. 5.1 Why is it that if they are proposing a 42 unit development don't they have to rezone the land residential and not special government as it is now?

5.2 Is it true that if it was residential R80 and they were building only on 2000m2, as they are, they would only be able to build 10 units?

Q6. Is the Council aware that the long blocks of land , approx the same size as Albany Bell, and referred to in the application as "non conforming factory" has recently been sold and accordingly to J.J Burns is to be developed into residential units.

Will decisions made on height, number of stories, side and rear setback on Albany Bell have any application for the development by setting presidents?

Q7. Is the Council aware that Thirlmere Road is partially closed to traffic, is subject to no parking and one hour parking restrictions and is the official cycle way in and out of Perth, and also that the proposed driveway into this development will be shared by the hospital car parks?
