DECLARATION OF OPENING OF MEETING

The Mayor declared the ordinary meeting of Council on 14 November 2000 open at 7.00pm.

ITEM: 1 PUBLIC QUESTION TIME

1.1 Mr J Tomala, 4/87 Abbott Street, Scarborough WA 6019

Q1 These are more objections to the proposed alteration of the food hall at Scarborough. There is now a total of 300 objections-does the Council intend to alter the use of the food hall?

1.2 Mr Wick, 3 Etwall Place, Carine, 6020

Q1 Will the premises have numbers (Accommodation Notice) on the amount of persons on the premises? Will they need an entertainment permit?

A1 The CEO expressed that it would be appropriate for Mr Johnson to respond to both Questions 1.1 and 1.2. The Executive Manager Development responded;

On the first question (1.1), all the objections but one were received outside of the advertising period, which are addressed in the supplementary report to Council. My own comment is that it is the content of the objections that is important and not the number of objections and the contents of those proforma objections have been addressed in the previous supplementary report.

On the second question this would be a public building and therefore subject to Public Building Regulations 1992 and the Health Act 1911. The answer is yes there would be an accommodation limit put on the building by the Health Department of Western Australia and I am not sure on the entertainment permit.

1.3 Mr & Mrs V & C Cikara, 62 Porter Street, Gwelup WA 6018

Q1 Why is the Council supporting or proposing to support a 500mm setback to the parapet wall, when two detailed independent investigations and reports and decisions, one by the Town Planning Appeal Tribunal and the other by the Hon Minister for planning have recommended the minimum setback be 1m and .595m respectively.

Nothing has changed since these decisions were made therefore the decisions were therefore made should remain the same.

A1 The Executive Manager Development responded;

The original application that Council dealt with many months ago was for a parapet wall on the boundary and the Council resolved at that time that a 500mm setback was appropriate and applied that condition. There was an appeal to the tribunal and the Council was aware the tribunal dismissed the appeal and in fact specified a 1 metre setback. A further application was then received showing a .595 metre setback, which again was refused by the Council. The appeal to the minister was upheld. The latest application for a parapet wall on the boundary was discussed by the Planning Committee last week and the Planning Committee saw fit to recommend a 500mm setback be applied.

1.4 Mr Wick, 3 Etwall Place, Carine, 6020

Q1 Why is it on this item 11.1/PL28 that the people making the application to change the use of the food court are not the people who are actually going to be operating it?

A1 The Executive Manager Development responded;

Mr Mayor, in town planning matters the Council deals with applications for the use of land and buildings and those applications have to be in the name of the owners of the premises. The application form requires the name of the owner.

1.5 Mrs C Aitken, 331 Alexander Drive, Dianella WA 6059

Q1 Could you please tell me why Denis Nichol (Engineering Department) on 20th April 2000 assured me that the residents urgent query regarding Verge Parking on Alexander Drive Dianella would take considerable time to deal with because it would have to go to Technical Services meeting and a full Council meeting plus a surveyor would have to go out there. Now today the Shire Administration discovered that it never went to any Council meeting at all.

A1 The CEO responded that the question would be taken on Notice and the Mayor indicated that the City would respond in writing.
