DECLARATION OF OPENING OF MEETING

The Mayor declared the Ordinary Meeting of Council on 23 January 2001 open at 7.00pm.

ITEM: 1 PUBLIC QUESTION TIME

1.1 M Anthony 4 Karrinyup Road Trigg WA 6029

Q1 Is the City of Stirling financially responsible for the purchase of the two remaining lots adjacent to Trigg ablution block Trigg Restaurant car park if they became available?

If the answer is No then was the Council meeting 12 December incorrectly informed by Councillor Tyzack?

A1 The Chief Executive Officer indicated that the matter would need to be investigated and a written response provided.

Q1 Why was the safety audit undertaken without giving local residents the opportunity to express their concerns to the independent survey team as agreed by the Chief Executive Officer at the Council meeting 12 December 2000?

Q2 Why did the project outline for the safety audit incorrectly inform prospective consultants that the vacant lot on the North-East corner is residential when, in fact it is public open space?

Q3 Why are two important letters about this matter, which were personally delivered on 18 January to the office of the Chief Executive Officer, still unanswered?

Q4 Has the safety audit been completed?

A1 The Chief Executive Officer indicated that a written response would be provided.

1.3 Mr G Rosich 168 Roberts Street, Joondanna (Re: Item PL24)

Q1 Council has rules and by-laws on building heights- why change the rules for one ratepayer?

"If this is passed then every ratepayer in the area is entitled to no height restrictions."

The Executive Manager Development provided the following response:

"Council has District Planning Scheme provisions and Policies on building heights. The Council also have discretion to vary all of those standards and rarely when exercised would that affect the amenity of the neighbour. I understand the question relates to Item PL24 on the agenda. In this case the Council did consider the plans first submitted and rejected them and requested revised plans from the applicant, which the City received. The revised plans meet all District Planning Scheme and Policy requirements in terms of height."
