The Mayor declared the ordinary meeting of Council of 21 May 2002 open at 7.05pm.

ITEM: 1 PUBLIC QUESTION TIME

1.1 E Caren, 47 James Street, North Beach

RE: PL20: Tavern and Bottle Shop / Lots 4 & 5 South East Corner Flora Terrace and Castle Street, North Beach

Q1 If you approve the proposal for a Tavern/Bottleshop is the Council going to be responsible 24 hours a day for security in the North Beach/Waterman area? Will traffic calmers be constructed in Flora Terrace and surrounding streets.

A1 The Executive Manager Development advised that security is a police matter although it is noted that the City does have its security patrols. Traffic calming is undertaken on an area wide basis.

Q1 Does the Council recognise that the wrong decision will result in a devaluation of existing properties and seriously impact upon the future potential development in the area when the right decision will result in an increase in value of properties and encourage future development?

A1 The Executive Manager Development advised the question was expressing a point of view and does not distinguish between which is the wrong and right decision.

Q1 Why was the City of Stirling officers report not mentioned at the Town Planning and Statutory Services Committee meeting of 14 May 2002?

Q2 How did our Coastal Ward Councillors arrive at a majority?

Q3 Could the City of Stirling's Planning Officers confirm that a "majority" exists?

Q4 The points 1.1 - 1.4 are covered by the officers' report. Why weren't they discussed?

Q5 Are the local Coastal Ward Councillors aware that R20 is the zoning for North Beach/Trigg/Waterman? Could they confirm that "Castle Rise" is R40 and does not conform with our zoning?

A1 The Executive Manager Development advised that reports are on the agenda and do not need to be specifically "mentioned" by the Committee.

A2 The Executive Manager Development advised he could not speak on behalf of the Ward Councillors and how they made their conclusions.

A3 The Executive Manager Development stated that his report indicated that there were more submissions against the proposal than in favour.

A4 The Executive Manager Development advised that he could not comment on what is or is not discussed by a Committee.

A5 The Executive Manager Development advised he could not speak on behalf of the Ward Councillors but was sure they would be aware of the R20 and R40 zonings.

1.4 K MacLaurin, 36 Woodroyd Street, Mt Lawley

Q1 Can Council request Western Power to defer any further work on the installation of the transformer cabinet outside 37 Woodroyd Street until the queries raised in our correspondence dated 15, 20 and 21 May have been resolved?

The cabinet is due to be installed Thursday or Friday this week and both our local councillors are away.

A1 The Chief Executive Officer advised that City officers from the Works Division have been in contact with Western Power to discuss options and have undertaken to contact the City tomorrow (Wed 22 May 2002) to rectify.

The Executive Manager Works further added that the works are effectively on hold while the City and Western Power resolve the issue.
